Suspect, 20, gets belligerent with Racine County sheriff’s deputies after she’s pulled over in Mount Pleasant while driving drunk.
A 20-year-old Racine woman is facing charges after she was pulled over for drunk driving in Mount Pleasant then got belligerent with Racine County sheriff’s deputies when they wanted her to take a Breathalyzer test.
Erin M. Smith was charged in Racine County Circuit Court Thursday with one count of resisting an officer. If convicted, she faces up to nine months in prison and $10,000 in fines.
According to the criminal complaint:
At 3:33 a.m. Thursday, a sheriff’s deputy was travelling northbound on Highway 31 when he spotted a small white car stopped at an intersection, then take off at a high rate of speed. The deputy paced the car at more than 60 miles per hour in a 45 miles per hour speed zone and noticed it also deviated from its lane several times.
The deputy pulled the car over and Smith was the only person inside. He noticed the smell of alcohol inside and had Smith perform field sobriety tests, which she failed.
He then asked Smith to perform a Breathalyzer test, which made her angry, saying she wouldn’t be arrested for drunk driving. The deputy told her he was placing her under arrest and she began to scream profanities and jerk away from the deputy.
She then threw herself to the ground and began to kick. Two deputies were eventually able to handcuff Smith and get her into the back of a squad car where she began to scream more and kick the safety glass.
She was taken to all Saints Hospital for a blood test, then transported to Racine County Jail where she was cited for drunk driving. She will make her initial appearance in court July 24.
